What a Colorado Professional Negligence Claim Must Establish
A viable case generally requires proof of four connected elements. Each must be supported by medical evidence and, in many cases, testimony from a qualified expert witness.
- Professional duty: The provider owed the patient a duty based on the treatment relationship.
- Breach of the standard of care: The provider failed to act as a reasonably careful professional would have acted under comparable circumstances.
- Causation: The provider’s failure caused or contributed to the patient’s injury.
- Damages: The injury resulted in losses such as additional medical expenses, lost income or earning capacity, disability, pain, emotional harm, or reduced quality of life.
A known treatment risk can occur even when appropriate care was provided. Establishing negligence often requires a careful comparison of the records, accepted medical practice, and the injury that followed.
Colorado Filing Deadlines & the Certificate of Review
Colorado Revised Statutes section 13-80-102.5 generally provides two years after a claim accrues. The statute also generally imposes an outside limit of three years after the act or omission. Exceptions may apply based on the treatment, discovery of the injury, defendant, and other facts, so the deadline shouldn’t be calculated without reviewing the specific circumstances.
When expert testimony is necessary, Colorado professional negligence cases generally require a certificate of review. This filing confirms that an attorney has consulted a qualified professional who found substantial justification for the case. The certificate is generally due within 60 days after service of the complaint, subject to governing law and the circumstances before the court.
Early review allows time to examine extensive records, assess the roles of multiple providers, and consult an appropriately qualified expert witness before filing deadlines expire.
