Minor Guardianship

When a child’s parents are deceased, incapacitated, or unable to provide adequate care, a relative or other interested person can petition the court to become the child’s guardian. The court evaluates the child’s best interests and, under Colorado law, presumes that limited guardianship, granting only the authority the child actually requires, is sufficient unless broader powers are clearly necessary.

Adult Guardianship

The Colorado Guardianship Process in El Paso County

For Colorado Springs residents, guardianship petitions are filed in El Paso County District Court. Understanding each step can reduce the risk of delays that can leave a vulnerable person without protection.

  • Filing the petition: An interested person files the guardianship petition. Colorado law follows a statutory priority order when deciding who to appoint: beginning with any guardian already serving, then anyone the respondent nominated through a durable power of attorney, then an agent under a medical or general durable power of attorney, then a spouse, and then other family members such as a parent or adult child.
  • Court Visitor investigation: After filing, the court assigns a Court Visitor to investigate whether guardianship is necessary, assess the proposed guardian’s suitability, and report findings and recommendations to the judge.
  • Notice requirements: The petitioner must serve proper legal notice of the hearing on the respondent and all interested persons at least 14 days before the hearing date. Missing this step can result in postponement or outright rejection of the petition.
  • The hearing: The court may grant a full or limited guardianship order based on the evidence presented. Once appointed, the guardian receives Letters of Guardianship as official proof of authority.

Appointment is the beginning, not the end. Colorado law imposes ongoing responsibilities on every guardian, and non-compliance carries real legal consequences.

Guardians must file annual reports with the court detailing the ward’s physical condition, medical services received, and the ward’s participation in their own decisions. Day-to-day duties include deciding where the ward lives, consenting to medical care, and meeting basic daily needs, all while encouraging the ward’s maximum independence. A guardian is a fiduciary; failure to disclose guardian status when acting on the ward’s behalf can result in personal liability for the ward’s debts. Certain decisions, such as authorizing involuntary treatment for mental illness or developmental disability, require a separate court process entirely. Non-compliance with court orders can lead to contempt findings, sanctions, or removal.

Guardianship vs. Conservatorship in Colorado

Colorado law separates these two roles. A guardian makes personal and health care decisions for the ward. A conservator manages the ward’s financial affairs and estate through a separate protective proceeding. A person may have both, and the court may appoint the same individual or different people to each role depending on the circumstances.
