Maximizing Your Claim

Accidents can happen and are a fact of life. Fortunately, when they occur on the job, you are likely eligible to obtain workers’ compensation benefits through your employer’s insurer. This type of no-fault insurance has been established by law to help those injured at work be compensated. This compensation takes the financial burden off your shoulders while you are recovering. The benefits provide the medical care you need to reach maximum medical improvement, as well as partial wage reimbursement when you are unable to return to the job during your recovery period.

Getting the benefits you deserve through worker’s compensation insurance is a precise process that must be followed. Ensuring that your claim is done according to law and with sufficient and correct documentation can be confusing and difficult. At Clawson & Clawson, LLP, we are deeply familiar with and practiced in handling and defending these claims, as well as making necessary appeals when a claim has been wrongfully denied. Backed by over a century of combined legal experience shared by our attorneys, we are a strong force to put behind your claim. We will seek the maximum amount of compensation possible in your case.

Workers’ Compensation Claims

Under workers’ compensation law, you are entitled to receive as much reasonable medical treatment that is needed to help you recover to “medical maximum improvement.” This can include emergency room visits, hospitalization, lab tests, surgery, medical equipment, prescription medication, and rehabilitative therapies.

You are also entitled to receive disability benefits that will be based on the type and extent of your injury or illness. Disabilities are categorized into four groups based on whether your disability is temporary or permanent, as well as whether it is partial or total.

The benefits available in these four groups include financial compensation amounting to two-thirds of your weekly earnings. In the case of permanent partial disability, compensation is based on an impairment rating that assigns a percentage of disability to your condition, with a cap on what is maximally available overall. Our team can work with you to ensure that your claim is calculated correctly and completed with full documentation.

Why Representation for Claims is Needed

Benefits are often denied based on mistakes in documentation, in meeting deadlines, due to seeking unauthorized medical help, or due to the insurer’s claims that your injury or illness was a preexisting condition or occurred outside of the work environment. It is also important to remember that for-profit insurance companies will often do whatever they can to reduce their payouts or deny claims. By retaining the services of an experienced attorney, your chances of succeeding in your claim will be greatly enhanced.

When facing the challenges of dealing with complex legal matters, you can count on the dedication and insight of our workers’ compensation attorneys in Parker. We are distinguished by numerous awards and recognitions, including a 10/10 “Superb” rating by Avvo, inclusion in The Best Lawyers in America, and a top AV® Preeminent Rating by Martindale-Hubbell®.
