Workers’ Compensation Claims
Under workers’ compensation law, you are entitled to receive as much reasonable medical treatment that is needed to help you recover to “medical maximum improvement.” This can include emergency room visits, hospitalization, lab tests, surgery, medical equipment, prescription medication, and rehabilitative therapies.
You are also entitled to receive disability benefits that will be based on the type and extent of your injury or illness. Disabilities are categorized into four groups based on whether your disability is temporary or permanent, as well as whether it is partial or total.
The benefits available in these four groups include financial compensation amounting to two-thirds of your weekly earnings. In the case of permanent partial disability, compensation is based on an impairment rating that assigns a percentage of disability to your condition, with a cap on what is maximally available overall.
