Dedicated Lawyers Holding Distracted Drivers Accountable

When a driver chooses to look away from the road, just for a moment, the potential dangers that lay ahead can be devastating, or even fatal. At Clawson & Clawson, LLP, we are committed Colorado Springs car accident attorneys who will advocate on your behalf after you are struck by a distracted or texting driver. Not only do you deserve financial compensation for your pain and suffering, you also deserve a professional legal team that can help you get it.

Distractions and the Distracted are Everywhere

According to the National Highway Traffic Safety Administration (NHTSA), it is estimated that about one in four traffic collisions involve a driver who was distracted by their cellphone. Disturbances come in all sorts, however, as something as simple as adjusting the radio or reading a billboard can inhibit the focus required to safely operate an automobile.

When you are behind the wheel of a car, you need to have three points of uninterrupted focus:

  • 1.) Cognitive: your mind is on the task
  • 2.) Visual: your eyes are on the road
  • 3.) Manual: your hands are on the wheel

It is important that you always take active measures to keep yourself from becoming distracted while driving. There are no ways to ensure other drivers are behaving responsibly, though, and car accidents will continue to happen. If you are in need of professional representation after a distracted driver hurt you or your loved ones, contact our firm today.

Consequences of Distracted Driving Car Accidents

When a driver allows themselves to ignore the road and focus on something else, they put themselves and everyone around them in serious danger. A high-speed collision can cause immediate and life-changing destruction that may cost thousands of dollars to repair or recover.

If you have suffered personal injury due to a distracted driver, you may be able to seek restitution that will cover:

  • Medical costs
  • Auto-mechanic fees
  • Rehabilitative programs
  • Wages lost as you recover
  • Damaged property bills
  • Punitive or nominal damages

Distracted Driving Accident FAQ

What are some of the most common types of driver distraction?

Driver distractions can take many forms, and some of those most common forms are smartphone use, talking with a passenger, looking at a billboard or a car accident, and adjusting the GPS or music player. If you were hit by a distracted driver, then there is a strong chance they were engaging in one of these types of distractions, most likely smartphone use.

Are auditory distractions real?

Technically, there are four types of driver distractions: visual, manual, cognitive, and auditory. An auditory distraction is a noise, sound, or song that is distracting the driver’s mind or making it unreasonably difficult for the driver to hear important traffic noises around them. Auditory distractions are much more likely to occur when a driver is wearing headphones, so it is recommended that you never use headphones or earbuds while driving.

What is the best way to deal with a distracted driver on the road?

If you spot a distracted driver on the road, then the best thing that you can do is to try to get away from them. You can assume that it is dangerous to be immediately adjacent to their vehicle, so try to put a few lanes or car lengths between you and them. If you think that the driver is so distracted that they could imminently cause a car accident, then you should note the make, model, color, and license plate of their car before pulling off the road to a safe location to call the police. Never try to stop a distracted driver on your own.

Is drinking water a distraction?

Most people want to have a little sip of water while driving. Unfortunately, this seemingly innocuous behavior is actually a dangerous form of distraction. Eating or drinking behind the wheel is always unsafe. You should only have water while your car is completely stopped.

Is it illegal or distracting to drive while barefoot?

Do you prefer to drive with your shoes off? You will be relieved to know that this is not illegal, even though many people believe it is. Driving barefoot can be distracting, though, if you’re not used to it, so it is usually not recommended. Sandals or flip-flops are also not recommended because the hell of the footwear can get snagged on the pedal unexpectedly.

Is driving while distracted more dangerous than driving while drunk?

Both distracted and drunk driving are extremely dangerous. Is one more dangerous than the other? Perhaps, but what is more important is to accept that they are both unsafe and to do what you can to avoid both behaviors.
